{"id":9841,"date":"2024-08-31T18:51:00","date_gmt":"2024-08-31T16:51:00","guid":{"rendered":"https:\/\/lsaletrado.com\/?p=9841"},"modified":"2024-08-31T18:53:38","modified_gmt":"2024-08-31T16:53:38","slug":"cume-ley-de-paridad-desprotege-a-las-familias-con-menores-afectados-por-cancer-u-otra-enfermedad-grave","status":"publish","type":"post","link":"https:\/\/lsaletrado.com\/?p=9841","title":{"rendered":"CUME: LEY DE PARIDAD DESPROTEGE A LAS FAMILIAS CON MENORES AFECTADOS POR C\u00c1NCER U OTRA ENFERMEDAD GRAVE."},"content":{"rendered":"\n<p>El pr\u00f3ximo 22 de agosto entrar\u00e1 en vigor la Ley Org\u00e1nica 2\/2024, de 1 de agosto, de representaci\u00f3n paritaria y presencia equilibrada de mujeres y hombres, conocida que ser\u00e1 como la Ley de Paridad.<\/p>\n\n\n\n<p>En este art\u00edculo analizamos como esta Ley <strong>afecta a los trabajadores que tienen la necesidad de solicitar una reducci\u00f3n de su jornada laboral<\/strong> por tener a su cargo a menores afectados por c\u00e1ncer u otra enfermedad grave, habida cuenta que, una vez m\u00e1s, la desconexi\u00f3n entre Ministerio a la hora de aprobar las leyes dibuja una realidad negativa para este colectivo.<\/p>\n\n\n\n<p>Entrando en materia, la Ley, en su disposici\u00f3n final novena, <strong>viene a modificar los art\u00edculos 53.4b) y 55.5b) del Estatuto de Trabajadores<\/strong> y, en ambos, se suprime la referencia al art. 34.8 del Estatuto que permite la reducci\u00f3n de jornada por cuidado de menor con enfermedad, <strong>eliminando con ello la nulidad del despido<\/strong> que se reconoc\u00eda de manera autom\u00e1tica en estos casos.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>La empresa que decida despedir en estas circunstancias, se arriesga a que el despido pueda salirle m\u00e1s caro<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Cuando un trabajador solicitaba la reducci\u00f3n por CUME, si la empresa lo desped\u00eda, operaba la nulidad del despido cuyo efecto inmediato es la reincorporaci\u00f3n del trabajador a su puesto en id\u00e9nticas condiciones. <strong>Ahora esa nulidad autom\u00e1tica ha desaparecido<\/strong> y se abre la puerta a un despido disciplinario y en ese caso la readmisi\u00f3n depende exclusivamente del empresario. Quien suscribe entiende que, a pesar del reciente cambio en la ley, al no operar la nulidad de manera autom\u00e1tica,<strong> ser\u00e1 el trabajador qui\u00e9n tendr\u00e1 que demostrar que ha sido despedido por haber pedido la reducci\u00f3n o adaptaci\u00f3n de jornada a sus circunstancias familiares<\/strong>, en este caso, atender la enfermedad de un menor. Si conseguimos probar que este ha sido el motivo del despido, tendr\u00eda que declararse la nulidad del mismo. Podr\u00eda decirse que estamos ante lo que llamamos la inversi\u00f3n de la carga de la prueba. Nos compete a nosotros probar que el despido se basa en el ejercicio de nuestro derecho a pedir una reducci\u00f3n para atender al menor.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Es importante dejar claro que todo depende de las circunstancias personales y particulares de cada caso<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>El despido debe ser comunicado por escrito y en la carta de despido debe detallarse el motivo del mismo, lo cual no podr\u00e1 ser modificado a posteriori. <strong>Si conseguimos demostrar que el motivo expuesto en la carta es falso, tendremos m\u00e1s posibilidades de lograr nuestro objetivo<\/strong>.<\/p>\n\n\n\n<p><strong>Europa entra en juego. Indemnizaci\u00f3n por despido.<\/strong><\/p>\n\n\n\n<p>Entendiendo que el despido en estas circunstancias es una decisi\u00f3n injusta para el trabajador que no se subsana con el pago de la indemnizaci\u00f3n.
